In performance of the obligations arising from the Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws 2024, item 1513, as amended) and the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2024, item 1796, as amended), MigraMate spółka z ograniczoną odpowiedzialnością with its registered office in Lublin at: ul. Jasna 6/13, 20-077 Lublin, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court Lublin-Wschód in Lublin with its seat in Świdnik, VI Commercial Division of the National Court Register under KRS number: 0001163710, NIP: 7123490726, REGON: 541257579 (hereinafter referred to as: MigraMate), hereby makes available to the User free of charge these Terms and Conditions specifying in particular:

  1. types and scope of services provided by electronic means;
  2. conditions for the provision of services by electronic means;
  3. conditions for concluding and terminating agreements for the provision of services by electronic means;
  4. complaint procedure.

I. DEFINITIONS

The terms used in these Terms and Conditions shall mean:

  1. Terms and Conditions – define the rules for the provision of services by electronic means by MigraMate, taking into account the consumer rights to which the service recipient is entitled in connection with the conclusion of a contract outside the business premises or at a distance, in accordance with Article 3a(2) of the Consumer Rights Act.
  2. Website – means the website available at www.migramate.pl, allowing users to learn about the types and scope of services provided by MigraMate, information about MigraMate, customer reviews, and enabling contact and booking of services, including Consultations.
  3. Calendly – a booking service enabling the scheduling and cancellation of Consultations.
  4. Stripe – a service enabling payment for Consultations.
  5. MigraMate – MigraMate spółka z ograniczoną odpowiedzialnością with its registered office in Lublin at: ul. Jasna 6/13, 20-077 Lublin, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court Lublin-Wschód in Lublin with its seat in Świdnik, VI Commercial Division of the National Court Register under KRS number: 0001163710, NIP: 7123490726, REGON: 541257579.
  6. Service Recipient – means a natural person intending to attend a Consultation as a Client and for this purpose makes a reservation and payment, or an entity (legal person or organizational unit) making a reservation and payment on behalf of another natural person as a Client.
  7. Client – a natural person using the Consultation.
  8. Consumer – a natural person performing a legal transaction not directly related to their business or professional activity.
  9. Consultation – a conversation or meeting during which MigraMate provides professional advice and support in the field of immigration via electronic communication, telephone, or in person at MigraMate’s office.
  10. Sole Proprietor with Consumer Rights – a natural person entering into a contract directly related to their business activity, where it follows from the content of that contract that it does not have a professional character for that person, in particular resulting from the scope of their business activity as disclosed pursuant to the provisions on the Central Register and Information on Economic Activity (CEIDG).
  11. Provision of service by electronic means – performance of a service provided without the simultaneous physical presence of the parties (at a distance), through the transmission of data at the individual request of the service recipient, sent and received by means of electronic data processing devices, including digital compression, and data storage, which is entirely transmitted, received, or conveyed via a telecommunications network within the meaning of the Act of 12 July 2024 – Electronic Communications Law.
  12. Means of electronic communication – technical solutions, including ICT devices and the software tools cooperating with them, enabling individual communication at a distance through the transmission of data between ICT systems, in particular electronic mail (e-mail).

II. BASIC INFORMATION

  1. MigraMate is an entity providing legal services, in particular professional advice and support in the field of immigration for individual and business clients, dealing with all aspects of immigration law and obtaining Polish citizenship.
  2. MigraMate is the owner of the Website and enables Service Recipients to reserve and cancel a Consultation date as a Client or on behalf of another natural person being a Client, as well as to make online payments via it.
  3. The functionalities of the Website are made available as an electronic service within the meaning of Art. 2 item 4 of the Act on the Provision of Services by Electronic Means. Use of the Website takes place using electronic devices and means of distance communication.
  4. Consultations provided by MigraMate realized via means of electronic communication in accordance with Art. 2 item 4 of the Act on the Provision of Services by Electronic Means constitute services provided by electronic means.
  5. An agreement concluded on the terms specified in these Terms and Conditions constitutes an agreement concluded at a distance within the meaning of the Act of 30 May 2014 on Consumer Rights.
  6. These Terms and Conditions are made available free of charge on the MigraMate Website, in a form that allows for its acquisition, reproduction, recording and printing.
  7. These Terms and Conditions simultaneously function as: a) general terms and conditions of agreements referred to in Art. 384 of the Civil Code – its provisions form part of the agreements concluded between the Service Provider and the Users; b) regulations for the provision of services by electronic means, referred to in Art. 8 of the Act on the Provision of Services by Electronic Means.
  8. The Service Recipient and the Client may familiarize themselves with the content of the Terms and Conditions at any time.
  9. Fulfilling the obligation arising from Art. 6 par. 1 of the Act on the Provision of Services by Electronic Means, MigraMate as the Service Provider informs about specific risks associated with the use of services provided by electronic means – that is:
    1. Increased risk of unauthorized access to personal data;
    2. Third party interference in data transmission;
    3. Phishing (including personal data extortion);
    4. Infection with malicious software, including computer viruses and tracking programs;
    5. Breaking encryption (cryptographic) protocols used in data transmission between ICT systems;
    6. Furthermore, during the Consultation, loss of connection and an interruption in the availability of the service related to the Internet connection may occur.
  10. Regardless of the fulfillment of the obligation referred to above, MigraMate makes every effort to minimize the risks associated with the use of services provided by electronic means by Service Recipients.

III. TYPES AND SCOPE OF SERVICES PROVIDED BY ELECTRONIC MEANS

  1. MigraMate provides services by electronic means consisting in:
    1. Reservation, change and cancellation of a Consultation date via the Website redirecting to the Calendly booking system and making online payments via the Stripe service;
    2. Contact via the contact form;
    3. Consultation using means of distance communication (video call).

IV. CONDITIONS FOR THE PROVISION OF SERVICES, INCLUDING SERVICES PROVIDED BY ELECTRONIC MEANS

  1. The Service Recipient is obliged to familiarize themselves with the content of these Terms and Conditions and accept its content when proceeding to book a Consultation on the Website.
  2. Starting to use the Consultation is equivalent to accepting the terms of these Terms and Conditions and concluding a service agreement with MigraMate.
  3. The Website is maintained by MigraMate in Polish and English.
  4. The Service Recipient is obliged to use the Website in a manner: a) not interfering with its operation; b) consistent with applicable law and the content of the Terms and Conditions; c) not violating the rights and personal interests of other Service Recipients and MigraMate.
  5. It is forbidden for the Service Recipient to take actions: a) which could block, overload or interfere with the proper functioning of the Website; b) sending unsolicited commercial information, introducing viruses or other malicious software; c) gaining access to information intended for other Service Recipients or to information to which access is restricted or prohibited.
  6. During the date reservation and concluding the agreement, the Service Recipient is obliged to provide true, complete and current data. The Service Recipient is responsible for the consequences of providing false or misleading data.
  7. The Service Recipient is obliged to refrain from actions that may hinder the use of the Website and hinder or prevent the use of services by other Service Recipients and Clients, including booking multiple available Consultation time slots in the calendar without the intention of attending them.
  8. Consultations take place on dates available in the Calendar located on the Website, in the “Book now” tab for the selected type of Consultation.
  9. In order to undergo one Consultation, the Service Recipient should book one date available in the calendar on the Website.
  10. Reservation involves the necessity of making payment for the Consultation – payment in advance, in accordance with the price list available at: https://migramate.pl/book-a-call-meeting/
  11. The availability and functionality of the Website may depend on the device used, network operator services, installed software and technical conditions on the part of the User or Client.
  12. MigraMate is not responsible for the lack of access to the Website or interruptions in the provision of services for reasons beyond its control, in particular problems with the Internet connection resulting from circumstances on the part of the internet provider or other data transmission services, the operating system used by the Service Recipient or Client, computer equipment or mobile device of the Service Recipient or Client infected with a virus, or its failure.
  13. MigraMate reserves the right to withdraw, temporarily suspend or modify individual services, including services provided by electronic means, provided they do not deteriorate the quality of the services provided and do not negatively affect the scope of rights and obligations of Service Recipients.
  14. MigraMate reserves the right to withdraw, temporarily suspend or modify the functionality of the Website in the event of the need to implement changes, improvements or maintenance and to improve the functioning of the Website or the tools used for video calls.
  15. The Website is available 24 hours a day, 7 days a week, subject to technical breaks and maintenance work – these works will be performed as far as possible during night hours.
  16. In-person consultations are provided at the headquarters of MigraMate at ul. Jasna 6/13, 20-077 Lublin, on the working days and hours of MigraMate, i.e., from Monday to Friday (excluding public holidays) exclusively during the hours of 8:00–15:00 (Polish time). These hours may be subject to change.
  17. An agreement concluded on the terms specified in these Terms and Conditions is terminated after the realization of the Consultation.

V. WITHDRAWAL FROM THE AGREEMENT

(Applies to a Service Recipient being a Consumer or a Sole Proprietor with Consumer Rights)

  1. The Service Recipient has the right to withdraw from the agreement without giving reasons and without bearing any costs by submitting a statement of withdrawal from a distance agreement in writing and sending it to the address of MigraMate: ul. Jasna 6/13, 20-077 Lublin or in documentary form via e-mail sent to the address: info@migramate.pl within 14 days from the date of conclusion of the agreement.
  2. In the case of booking a Consultation date along with making an online payment in a period shorter than 14 days from the date of conclusion of the agreement, par. 3 and 4 below shall apply.
  3. If the Service Recipient declares their intention to use the Consultation (selects a Consultation date) before the expiry of 14 calendar days from the conclusion of the contract, this shall be deemed equivalent to submitting a statement that they request the Consultation to be provided before the expiry of the 14-day withdrawal period and that they acknowledge that, in such case, they will lose the right to withdraw from the contract.
  4. If a Consultation is booked by the Service Recipient for the benefit of another person within a period shorter than 14 days from the date of conclusion of the contract, MigraMate informs that the performance of the Consultation results in the loss of the right to withdraw from the Contract, to which the Service Recipient must give consent during the booking process.
  5. In order to exercise the right of withdrawal from the contract, the form attached as an appendix to the Terms and Conditions may be used; however, this is not mandatory.

VI. TECHNICAL REQUIREMENTS NECESSARY FOR COOPERATION WITH THE ICT SYSTEM

  1. In order to use a Consultation provided using means of distance communication (video call), it is necessary to meet the following technical conditions:
    1. having access to the Internet;
    2. having active access to e-mail;
    3. having a device with access to the Internet, equipped with a web browser;
    4. accepting necessary cookies;
    5. having JavaScript enabled in the browser used by the Service Recipient or Client;
    6. having a working microphone and camera on the computer equipment or mobile device used during the Consultation.
  2. In the event of technical disruptions during the Consultation, the Client should contact MigraMate via the contact details provided on the Website.

VII. BOOKING A CONSULTATION DATE AND CHANGING THE RESERVATION DATE

  1. Booking a Consultation can be done in the following manner:
    1. in person at the headquarters of MigraMate (ul. Jasna 6/13, 20-077 Lublin);
    2. via phone;
    3. via e-mail;
    4. via the Calendly booking service system;
    5. via the contact form available on the Website.
  2. The conditions for using external booking systems are governed by separate regulations made available by the operators of these systems.
  3. The booking of a Consultation via the Website shall be carried out in the manner described in detail below.
  4. In order to book a Consultation, the calendar available on the Website under the “Book” tab for the selected type of Consultation must be used.
  5. The Service Recipient may book a Consultation for themselves as the Client or for another person as the Client.
  6. After accessing the calendar, the Service Recipient should select the type of Consultation, and then choose the date (day) and time of the Consultation from the available time slots indicated in the calendar.
  7. After clicking on a time slot on the selected date, the Service Recipient proceeds to the summary page, where they:
    1. Provide the necessary personal information, such as: first name, last name, e-mail address, guest’s e-mail address (meaning the Client in cases where the Service Recipient is booking the Consultation on behalf of another person), and phone number.
    2. Select the form of Consultation (in-person meeting at MigraMate’s office at ul. Jasna 6/13, 20-077 Lublin, telephone call, or video call).
    3. Answer the questions provided.
    4. Choose the method of payment.
    5. Optionally, make the payment using the available payment option.
  8. Payment in full in advance for the Consultation is a condition for the effective booking of the Consultation, and in the case of an in-person Consultation at MigraMate’s office with cash payment, it is a condition for the Consultation to take place.
  9. After completing the steps mentioned above, the Service Recipient receives a confirmation of the Consultation booking at the provided e-mail address. In the case of a Consultation conducted via electronic communication means, the Service Recipient also receives a link to the Consultation at the provided e-mail address.
  10. Consultation prices are presented clearly and understandably; the amounts indicated are gross prices expressed in Polish currency.
  11. MigraMate may introduce promotions and discounts regarding Consultation prices – their duration and terms of application are specified for each Consultation individually.
  12. When informing about a reduced price, MigraMate also indicates the lowest price of that Consultation applicable within the 30 days preceding the reduction. If the Consultation has been offered for less than 30 days, the lowest price from the start date of its offering until the date of the reduction is indicated.
  13. MigraMate reserves the right to change Consultation prices, including the right to introduce or withdraw promotions and discounts.
  14. The changes referred to in sections 12 and 13 above shall not affect contracts concluded prior to their introduction.
  15. The information, announcements, advertisements, and price lists posted on the Website constitute an invitation to conclude a contract (invitatio ad offerendum) and do not constitute a standalone offer or a guarantee regarding the properties of the product within the meaning of the Civil Code.
  16. The Service Recipient may choose one of three payment methods for the Consultation:
    1. Online payment (redirected after completing the booking).
    2. Traditional bank transfer.
    3. Cash – at MigraMate’s office, available only for Consultations in the form of an in-person meeting at MigraMate’s office at ul. Jasna 6/13, 20-077 Lublin.
  17. Online payment – Payment is made via the Service Recipient’s chosen payment service provider. The Service Recipient receives a payment link that redirects them to the payment operator’s page to complete the transaction immediately. The Service Recipient provides the authentication data required by the operator. Payment through the online payment operator is recorded immediately, which confirms the payment for the Consultation. Detailed terms of payment via the payment operator are set out in the operator’s regulations. If payment is not made, the booking is cancelled.
  18. Traditional bank transfer – The Service Recipient is obliged to send MigraMate proof of the transaction to secure the Consultation booking, immediately, no later than 24 hours after making the booking. If payment is not made or proof of transfer is not sent within the specified time, the booking will be cancelled.
  19. If the booking is made less than 24 hours before the scheduled Consultation, the Service Recipient must send proof of the transfer within 1 hour of completing the booking. If payment is not made or proof of transfer is not sent within this time, the booking will be cancelled. In case of cancellation of a booking made in this manner, the payment is non-refundable and is treated as compensation for the specialist’s reserved time.
  20. Cash payment – Payment is made at MigraMate’s office prior to the Consultation.
  21. The Service Recipient may reschedule the Consultation by sending an email to MigraMate at info@migramate.pl requesting a change of date, after which MigraMate will propose alternative Consultation dates within no more than 14 days from the original Consultation date.
  22. The Consultation rescheduling must be made no later than 24 hours before the originally booked Consultation time.
  23. If the Consultation is rescheduled less than 24 hours before the originally booked time, the payment for the Consultation is non-refundable and is treated as compensation for the specialist’s reserved time. If the Service Recipient still wishes to use MigraMate’s services, a new Consultation appointment must be booked, and a new payment must be made.
  24. If circumstances on the part of the Service Provider prevent the Service from being performed on the scheduled date, the Service Provider shall promptly inform the Service Recipient of the reason for the inability to provide the Service and propose available alternative dates. In such a case, the Service Recipient may choose another date or cancel the Service and receive a full refund of the amount paid. MigraMate will refund the amount paid for the Consultation using the same payment method used by the Service Recipient, unless the Service Recipient agrees to a different refund method. The refund for the Consultation will be made no later than 14 days. If the refund is to be made to an account specified by the Service Recipient, the Service Recipient is obliged to provide complete and correct information necessary to execute the transfer (e.g., bank account number).

VIII. CONSULTATIONS

  1. MigraMate offers three types of Consultations:
    1. Case Analysis: a call or meeting lasting 45 minutes;
    2. Business Advisory: a call or meeting lasting 2 hours, after which the Client receives a summary note;
    3. Immigration Strategy: a call or meeting lasting 3 hours, after which the Client receives a personalized guide.
  2. The Consultations listed above are provided on a paid basis only. Current Consultation prices are available on the Website under: https://migramate.pl/book-a-call-meeting/
  3. A Consultation via electronic communication means is conducted through a video call with a MigraMate representative, using the video call software indicated in the e-mail received after booking the Consultation.
  4. A Consultation in the form of a telephone call is conducted via a phone call to the number provided by the Service Recipient.
  5. The initiation of the call—both video and telephone—is done by MigraMate.
  6. The condition for starting a Consultation is the confirmation of the Client’s identity by MigraMate. For this purpose, MigraMate may require the Client to provide personal information identifying them and/or present an identity document.
  7. On the date and time of the booked Consultation, MigraMate will initiate contact with the Client. The attempt to establish the connection will be made three times, with the final attempt occurring within 15 minutes after the scheduled Consultation time.
  8. If the Client does not respond via the indicated communication method within 15 minutes after the scheduled time, or, in the case of an in-person meeting at MigraMate’s office, if the Client does not arrive within 15 minutes after the scheduled time, the Consultation shall be considered as having taken place, and the payment made by the Service Recipient is non-refundable.
  9. MigraMate shall not be liable for the non-performance or interruption of the Consultation due to reasons attributable to the Service Recipient or Client, including failure to meet the technical requirements set out in these Terms and Conditions.
  10. The Consultation includes, in particular, a review of the Client’s documents and situation, discussion of available options, provision of practical advice, and guidance on next steps or a personalized action plan.
  11. If the Consultation is extended at MigraMate’s initiative, for example, to conduct a longer interview or analyze documents, no additional fee will be charged.
  12. MigraMate may require the Client to provide additional documents.

IX. COMPLAINTS

  1. Complaints regarding services provided by MigraMate may be submitted in the following ways:
    1. By letter sent to MigraMate at: ul. Jasna 6/13, 20-077 Lublin;
    2. By e-mail sent to: info@migramate.pl
  2. A complaint should include the following information:
    1. The Service Recipient’s details allowing for their identification;
    2. Correspondence address or e-mail of the Service Recipient;
    3. A description of the issue related to the complaint;
    4. The Service Recipient’s requested resolution;
    5. In the case of a written complaint – the Service Recipient’s signature.
  3. Complaints will be handled by MigraMate without undue delay, and no later than 14 days from the date of receipt.
  4. MigraMate reserves the right to contact the Service Recipient in case of any doubts regarding the complaint.
  5. Within the timeframe specified in section IX, point 3 above, MigraMate shall provide the Service Recipient with a response to the complaint either in writing or by e-mail to the address indicated by the Service Recipient—depending on the form in which the complaint was submitted.

X. PERSONAL DATA

  1. The administrator of personal data is MigraMate Sp. z o.o.
  2. Detailed information regarding the scope and purpose of personal data processing, the rights of data subjects, and the principles of data protection is provided in the Privacy Policy.

XI. FINAL PROVISIONS

  1. These Terms and Conditions shall apply from 01.03.2026.
  2. MigraMate reserves the right to amend these Terms and Conditions for the following reasons:
    1. Changes in legal regulations requiring amendment or updating of these Terms and Conditions to ensure compliance with legal requirements;
    2. Obligations arising from a final court judgment or administrative decision, including the recognition of any provisions of these Terms and Conditions as abusive clauses;
    3. The need to improve the security of Service Recipients and Clients;
    4. Implementation of improvements to the Website;
    5. Implementation of new functionalities or modification of existing functionalities on the Website;
    6. The need to prevent abuse related to the use of the Website;
    7. Changes in the terms of service provision, including withdrawal of services or addition of new services, whether paid or free of charge;
    8. The need to introduce editorial changes to the Terms and Conditions to correct stylistic, grammatical, or spelling errors, update legal bases referenced in the Terms and Conditions, and remove interpretational ambiguities regarding the provisions of these Terms and Conditions.
  3. MigraMate shall inform Service Recipients about the changes to the Terms and Conditions, the scope of the changes, and the reasons for the changes via information posted on the Website.
  4. Changes to the Terms and Conditions shall take effect on the date specified by MigraMate, but no sooner than 14 days from the date on which MigraMate informed Service Recipients of the changes, unless applicable law, an administrative decision, or court ruling requiring the changes provided otherwise.
  5. Neither changes to the services provided by MigraMate nor changes to these Terms and Conditions shall affect paid services that the User has used prior to the effective date of the changes, or booked and paid Consultations made before the effective date of the changes.
  6. In matters not regulated by these Terms and Conditions, the provisions of the law applicable in the territory of the Republic of Poland shall apply.
  7. MigraMate reserves the right to change the e-mail addresses provided in these Terms and Conditions; such changes do not constitute an amendment to the Terms and Conditions.
